Section 1

Definitions

Platform: The website www.clurq.com and related mobile or web applications.

User: Any person or organization using the Platform, including Employers, Talent Agencies (TAs), Freelancers, and Job Seekers.

Employer: A company or individual posting job or talent requirements.

Talent Agency (TA): An entity or individual managing or referring candidates for Employer roles.

Freelancer: A professional offering independent services via the Platform.

Job Seeker: An individual applying for jobs or authorizing representation through TAs.

Services: The hiring, bidding, communication, and related tools provided by Clurq.

Section 2

Acceptance of Terms

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree, please discontinue use of the Platform.

Section 3

Eligibility

You must be at least 18 years of age or the legal age of majority in your jurisdiction.

Users registering on behalf of a business or agency represent that they are duly authorized to do so.

Section 4

Account Registration and Security

You must create an account with accurate and current information.

You are responsible for maintaining the confidentiality of your account credentials.

You agree to notify Clurq immediately of any unauthorized access or breach.

Clurq reserves the right to suspend or terminate accounts that are inaccurate, fraudulent, or misused.

Section 5

Roles and Responsibilities

Employers • May post job openings, projects, or talent acquisition requirements. • Must ensure job postings are truthful, non-discriminatory, and lawful. • Are solely responsible for payments, communications, and compliance with labor and employment laws.

Talent Agencies (TAs) • May submit candidates, referrals, or bids on behalf of Employers. • Must have consent from Job Seekers before submission. • Are responsible for ensuring data accuracy and authenticity.

Freelancers • Offer professional services and engage independently. • Clurq does not guarantee work, payments, or employment relationships. • Freelancers are responsible for taxes, invoices, and legal compliance in their jurisdiction.

Job Seekers • May apply directly to job posts or authorize TAs to represent them. • Must ensure that all submitted information is truthful and current. • Are not employees of Clurq; all arrangements are directly between the Job Seeker and the hiring party.

Section 6

Acceptable Use Policy

Users agree not to:

  • •Violate any laws, contracts, or third-party rights.
  • •Post or share false, misleading, or infringing content.
  • •Use bots, crawlers, or automated data extraction tools.
  • •Engage in harassment, spam, or abuse.
  • •Circumvent platform fees or interfere with security measures.
  • •Impersonate others or misrepresent affiliations.

Violation may result in immediate suspension or permanent ban.

Section 7

Payments, Fees, and Refunds

Some Platform services may involve paid plans, success fees, or commissions.

Payments are securely processed through authorized third-party gateways.

Fees are non-refundable unless expressly stated.

Clurq is not responsible for disputes between Users (e.g., Employers and Freelancers).

In case of fraud or legal investigation, Clurq reserves the right to withhold or reverse payments.

Section 8

Communication and Messaging

Users may communicate through the Platform or via integrated messaging tools.

Clurq may monitor communications to ensure safety, compliance, and fraud prevention but will not disclose contents unless required by law.

Section 9

Intellectual Property

All Platform content (design, text, graphics, software, etc.) is owned by Clurq and protected by copyright and IP laws.

Users retain ownership of content they upload but grant Clurq a non-exclusive, worldwide, royalty-free license to use, store, and display it for service operation.

Unauthorized use or reproduction of Platform material is prohibited.

Section 10

Confidentiality

Users must treat as confidential any information obtained through the Platform and use it only for legitimate business purposes.

This obligation continues after account termination.

Section 11

Limitation of Liability

To the maximum extent permitted by law:

  • •Clurq provides services "as is" and "as available."
  • •We do not guarantee accuracy, availability, or uninterrupted access.
  • •Clurq is not liable for indirect, incidental, or consequential damages.
  • •Our total aggregate liability shall not exceed the total fees paid by you to Clurq in the three (3) months preceding the event giving rise to the claim.
Section 12

Indemnification

You agree to indemnify, defend, and hold harmless Clurq, its directors, employees, and affiliates from any claims, damages, or losses arising out of:

  • •Your use of the Platform,
  • •Breach of these Terms, or
  • •Violation of any law or third-party rights.
Section 13

Suspension and Termination

Clurq may suspend, restrict, or terminate any account:

  • •For violation of these Terms,
  • •Upon legal or governmental request, or
  • •For inactivity exceeding a reasonable period.

Users may request deletion of their account by contacting contact@clurq.com.

Certain data may be retained as required by law.

Section 14

Governing Law and Jurisdiction

These Terms are governed by international principles and the laws of India, without regard to conflicts of law.

Disputes shall be resolved by binding arbitration in Gurugram, Haryana, India, under the Arbitration and Conciliation Act, 1996.

The language of proceedings shall be English.

Section 15

Dispute Resolution (Global Compliance)

For Users located in:

EU/UK: You may contact your local supervisory authority before formal arbitration.

US or Other Jurisdictions: Disputes shall first attempt amicable resolution via written notice to contact@clurq.com.

Section 16

Modifications

Clurq reserves the right to modify these Terms at any time.

Changes will be effective upon posting to the Platform. Continued use after updates constitutes acceptance of the revised Terms.
